Introduction

By participating in the World Naked Gardening Day Release the Jungle competition, you agree to these terms and conditions. Designer Plants, trading as Saber International Pty Ltd, are running the competition.

Eligibility to Enter

The competition is open to entrants in Australia over 18 years of age. Employees and third parties associated with Designer Plants are not eligible to enter.

By entering the competition, you confirm that you are eligible to do so and that you are eligible to receive any prizes that may be awarded to you. 

There is a limit of one entry per person, and the competition is completely free to enter.

Entrants must not attempt to submit or upload any content or material that is intended to cause harm to any individual or organisation, including any computer viruses, malware, ransomware, or other malicious code. 

Entrants agree not to interfere with or disrupt the competition or the entry mechanisms or attempt to gain unauthorised access to any computer system, server, website, or other resource used in connection with the competition. 

Entrants must not submit any content or material that is illegal or violates any applicable laws or regulations. Entrants must not submit any content or material that is copyrighted, trademarked, or otherwise proprietary. 

The submission of content must not be pornographic, obscene, or otherwise offensive. The content should be PG rated. As such but not limited to the covering of private parts. If the content contains other individuals, the entrant must have written permission to include them in any entry and is liable for their entry. Entries must not infringe on the rights of any third party. 

The Reward

The winning prize will be assigned in the order of the discretion of the promoter, based on the judge’s criteria and made at the sole discretion of a judge (not a lucky draw).

Prize 1: $1000 Designer Plants voucher and $500 plants package of the promoter’s choosing.

Prize 2: $500 Designer Plants voucher

Prize 3: $250 Designer Plants voucher

Only one prize is given per winner.

The prize is non-transferable and non-exchangeable, and no cash alternatives will be provided.

We reserve the right to substitute prizes of equal or greater value if circumstances beyond our control require doing so.

Designer Plants decision on any aspect of the competition is final and binding, and no correspondence will be entered into about it.

Winner Announcement

The winner for each of the three prizes will be chosen based on the level of creativity to the response from the competition and their photo entry as judged by the promoter. Entries to the competition open from 27 April 2023 5pm and close 8 May 2023 5pm Australian Eastern Standard Time.

The promoter will make the order of the winners. When a winner is chosen by 10 May 2023, the winners will be contacted via email. The promoter will make two attempts to contact the winner with the email they provide.

If the winner does not respond to the emails informing them of their win within 14 days of the second email, they forfeit their right to claim of any reward, and Designer Plants reserves the right to select and notify a new reward recipient.

Delivery of the Reward

The receipients will allow 14 days for the prize to be delivered. Otherwise, alternative collection or delivery arrangements can be made through mutual agreement.

A voucher will be provided via electronic means and is valid for 12 months.

Data Protection and Publicity

You agree that Designer Plants will use any personal information you provide when entering the competition to administer the competition and for other purposes as specified in our Privacy Policy.

By entering the competition, entrants agree to grant Designer Plants a royalty-free lifetime license to use, reproduce, modify, publish, create derivative works from, and display any content, materials or photographs they provide in connection with the competition for any purpose, including marketing. The entrant is solely responsible for ensuring that they are not infringing any third party’s copyright and that the materials they provide are not subject to copyright or owned by others without the copyright holder’s explicit permission. All entrants must comply with Australian and International copyright laws.

All entrants to the competition may have their entries published on social media, via email or other marketing channels.

Limitation of Liability

Designer Plants accepts no liability for any damage, loss, injury, or disappointment suffered by any entrants as a result of participating in the competition or being selected for a reward.

Designer Plants and its third parties shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or relating to the competition, including, but not limited to, damages for loss of data or profits arising out of or in connection with the use or performance of the competition. 

Designer Plants further disclaims any and all liability for any loss or damage that the participant or any third party may incur as a result of the participant’s participation in the competition. The Company does not guarantee or make any representations regarding the accuracy or reliability of any information or results obtained through the competition. 

Designer Plant sshall not be liable to the Entrant or any third party for any damages or losses resulting from the participant’s use of or reliance on any information or results obtained through the competition. By participating in the competition, the Entrant hereby releases, discharges, and holds harmless Designer Plants from any and all liability in connection with the participant’s participation in the competition.​​

You agree that by participating in the activity, or related activity you indemnify Designer Plants against any action or cause of action brought against Designer Plants as a result of your action, including but not limited to: copyright infringement, damage to property, or any other action that may cause loss to another.

You also agree you will not disparage or engage in any harmful, insulting or defamatory language about any participant, or facilitator of the contest.

General

Designer Plants reserves the right to cancel the competition or amend these terms and conditions at any time and without prior notice.

If any of these clauses shall be warranted as void, all other clauses shall be in full effect. These terms and conditions are governed by Australian law.

This competition is not affiliated with Facebook.

You accept that by participating you are doing so on the basis of good humor, and having fun, not as a career, money making labor, or any other form of activity that is a fee for service.
